01 Mar Updates Regarding OPWDD ADMs 06-ADM-01R and 21-ADM-02R
OPWDD has posted the finalized ADMs 06-ADM-01R regarding Group Day Habilitation Service Documentation Requirements and 21-ADM-02R regarding Requirements for Community Habilitation-Residential Services Delivered in the Individual’s Certified Residence.
Regarding 06-ADM-01R, this memorandum describes the service documentation requirements for Group Day Habilitation and Supplemental Group Day Habilitation. Day Habilitation services can help people to acquire, retain or improve their self-help skills, socialization and adaptive functioning by working on skills like communication, travel and other areas in adult education to help people gain independence. This ADM has been updated to reflect that on November 11, 2023, when the COVID-19 Appendix K authority ended, Day Habilitation services can no longer be provided in certified residences. People who do not live in a certified residence may continue to receive in-person or remote Day Habilitation services in their own home. This ADM describes the service documentation requirements for appropriate Day Habilitation service billing. Regarding 21-ADM-02R, this memorandum updates existing requirements for Community Habilitation-Residential (CH-R) services. CH-R services are Community Habilitation services delivered to individuals living in certified residences (Individualized Residential Alternatives (IRA), Community Residences (CR), or Family Care Homes (FCH)). Individuals living in certified residences may receive CH-R services either inside the residence or outside the residence, depending upon the needs of the individual. These ADMs were edited in responses to some of the public comments received. The public comments are added as an attachment for each ADM.
OPWDD has also attached the public comments received to 21-ADM-03R (https://opwdd.ny.gov/regulations-guidance/adm-2021-o3r-ability-use-technology-remotely-deliver-home-and-community-based) and 23-ADM-08 (https://opwdd.ny.gov/regulations-guidance/adm-2023-08-service-documentation-community-habilitation-services-provided). These ADMs were not changed.
